IDAHO FALLS, Idaho (AP) — A bail bondsman won't be charged after police say he shot and killed a wanted man in Ammon.

KIFI-TV in Idaho Falls reports that prosecutors will not charge 30-year-old Dwayne Schulthies in the March shooting of an armed man in an apartment complex parking lot. Schulthies was among bondsmen who tried to arrest the 58-year-old Philip Clay, who was carrying a handgun. Schulthies has a criminal background that includes a DUI and drug possession.

The Bonneville County Prosecutor's Office said in a news release Tuesday that Clay had indicated he had a gun and would not go down without a fight. The statement said that bond agents had tried to arrest Clay several times without force, but weren't successful. There is no evidence that Clay fired any shots.
