Burley, Idaho ( KMVT-TV / KSVT-TV ) A Burley man who spent nearly ten years in prison for aggravated assault is suing 65 people related to his case.

Dana Lynn Rose filed the suit against several district judges prosecutors and his own lawyer. Rose is also targeting a court reporter who he alleges omitted vital appeal-able statements in the courts transcripts. Rose was convicted and sentenced to 4 to 10 years in prison for beating a chair with an aluminum bat while his ex girlfriend was lying near the chair.

Trial court administrators don't think that anything will come of this case. "Many of them are judges and several of them are absolutely have judicial immunity which is as long as they are in their jurisdiction it's pretty hard to successfully sue one of them" says Linda Wright, Trial Court Administrator for the Fifth Judicial Court. Rose blames his conviction on several factors including his attorney. He was released from prison in 2009.
