Case Against One Dietrich Teen in Assault Case Dismissed
SHOSHONE, Idaho (KMVT/KSVT) – The case against one of three teenagers involved in a forcible penetration case against a fellow classmate in Dietrich has been dropped.
The paperwork to dismiss the felony charge of forcible penetration by use of a foreign object against Tanner Ward was filed with the court Thursday, and signed by Judge John K. Butler.
Ward’s pretrial was initially set for Sept. 6, with a trial set for Sept. 21.
John R.K. Howard, another person charged in the incident, will be arraigned in District Court 3 p.m. on Sept. 6 in Gooding County.
The case was dismissed without prejudice, which mean “it leaves the plaintiff free to bring another suit based on the same grounds, for example if the defendant doesn't follow through on the terms of a settlement,” according to Nolo's Plain-English Law Dictionary.
