RIGBY, Idaho (KTVB) -- A former Jefferson County sheriff has asked that his conviction for misuse of funds be overturned or that he be granted a new trial.

The Post Register reports Blair Olsen was convicted May 13 in Twin Falls on three separate counts of felony misuse of public funds for issuing a cellphone for his wife's personal use.

In the motion to acquit, Olsen's attorneys argue that the State of Idaho did not have jurisdiction on the matter. In the motion to retry the case, three separate affidavits claim two jurors fell asleep during the trial.

The judge on the case will consider the latest motions prior to Olsen's sentencing June 22. The Idaho Office of the Attorney General has until June 12 to file answers to the motions.
