IDAHO FALLS, Idaho (AP) — Bonneville County Prosecuting Attorney Daniel Clark says that the deputies and police officers that shot a man on June 29 were justified in their use of deadly force.

Sheriff's deputies Nicholas Contreras, Austin Flegel and Christopher Rix, and Idaho Falls police officers Bart Whiting and Daniel Godfrey were all at the scene when Ricky Mosley was shot. Mosley was pulled over at a gas station by authorities responding to a domestic violent report. Mosley exited his vehicle and had refused to follow officers' commands.

Clark says Mosely had his hands in a shooting position while he held a cell phone that officers thought was a weapon. The deputies and officers then fired at Mosley. He was listed in fair condition Tuesday after being in critical condition for nearly two weeks.
