A southern Idaho prosecutor won't file criminal charges in the case of a 2-year-old boy who was shot and killed by his 3-year-old brother last week. Brandon Herrera died early last Thursday morning at a Boise hospital after being shot in the forehead with a .22 caliber revolver. Minidoka County Prosecuting Attorney Lance Stevenson says this tragic incident is a reminder of the importance of safely storing weapons, but that the case doesn't merit criminal charges against any members of Herrera's family. Rupert Police Department officials concluded the 3-year-old boy found his grandfather's loaded revolver in an unsecured gun safe located inside the family's home last Wednesday. The boys' mother was in the home in another room at the time of the shooting.
