BOISE, Idaho (AP) — Full beer growlers could be considered open containers under Idaho law, and state police are asking the Legislature to make a change. The fix? Tape, the agency says.

KBOI-TV reports retailers are filling the reusable jugs, screwing on the caps, and sending customers out the door to face a fine - even if the growlers haven't been opened. A ticket for having an open container of alcohol can cost up to $300, although many beer drinkers in Boise don't know they're risking a citation.

"The thought of being pulled over and getting in trouble for it has never crossed my mind actually," said Jeret Whitescarver of Boise. State police want a law that would require official tape on every growler cap when beer is sold. The agency estimates the seals would cost about 10 cents per container.

"It's a minimal cost. It might actually be the same cost as an actual cap to put on the growler, so I don't think it will change too much," said Justin Flynn, owner and founder of Prefunk Beer Bar in Boise. The rule passed a house committee Thursday and will be heard by a senate committee next week.
