BOISE, Idaho (Press Release) – The Idaho Department of Insurance is working on proposed rules for the 2017 legislative session and intends to hold public meetings and receive comments as part of its negotiated rulemaking process.

Written comments will be received through July 27, 2016. This is the first opportunity for public comment, there will be other opportunities going forward.

Public meetings will be held at the Boise office located at 700 W State St, third floor, for anyone wishing to participate in the negotiated rulemaking.

  • Thursday, July 21, 1:30 p.m. – 18.01.10 – Producers Handling of Fiduciary Funds – amending the existing rule concerning bail to treat cash collateral as fiduciary funds
  • Thursday, July 21, 3:00 p.m. – 18.01.29 – Restrictions on Discretionary Clauses in Health Insurance Contracts – addresses “discretionary clauses” in health insurance policies
  • Tuesday, July 26, 1:30 p.m. – 18.01.50 – Adoption of the International Fire Code – amends the existing rule to change the language to match the anticipated adoption of the 2015 International Building Code by the Division of Building Safety
  • Monday, July 25, 1:30 p.m. – 18.01.54 – Rule to Implement the NAIC Medicare Supplement Insurance Minimum Standards Model Act – requires all Medicare Supplement carriers to offer coverage to pre-65 Medicare eligible individuals; clarifies the requirement to account for interest in projections; and clarifies rating/underwriting factors that can be used and when, i.e., smoking, weight, height, etc.

Negotiated rulemaking notices and drafts of the rules revisions are available on the Department website, additional information will be posted to the same website as the rules progress.
