Prosecutors Not Charging Nurse in Baby’s Death

TWIN FALLS, Idaho (AP) — Prosecutors are not pursuing criminal charges in the death of a 7-month-old boy who died after a nurse gave him another patient's medication.

KTVB-TV reports a Friday news release by the Twin Falls County Prosecuting Attorney says August Elliott's death did not amount to a crime under the involuntary manslaughter statute.

The news release says a traveling, temporary nurse worked in hospitals where small saline bags are typically used for pediatric patients. One nurse had prepared an adult dose of a saline solution infused with potassium phosphate, and the traveling nurse mistakenly concluded it was for Elliott.

The hospital has amended procedures since the death, including a new requirement in pharmacy protocols that incorporates the use of colored labels. The family can pursue other legal action in court.
