LEWISTON, Idaho (AP) — An Idaho sheriff's deputy has been cleared of criminal charges after shooting a Lewiston man after a chase.

The Lewiston Tribune reports that Lewis County Prosecutor Zachary Pall cleared Nez Perce County sheriff's deputy Cpl. Sam AuGello on Tuesday. AuGello shot 28-year-old Joseph R.J. Case after a chase. He says Case fired a handgun at the deputies chasing him.

Pall said evidence collected by Idaho State Police shows that AuGello was acting in good faith and without malice. Case has pleaded not guilty to shooting at deputies and eluding. His trial is set for July 8.
